Ron McQueen provided a status report on the Department's budget.

HUNTER EDUCATION STUDENT MANUAL -- BRIEFING:
Rich Mann briefed the Commission on the new hunter education student manual, and how the manual will be integrated into the Department's new online hunter education testing process.

SCIENTIFIC COLLECTION PERMITS -- RULE BRIEFING:
Evan Jacoby and Frank Hawley briefed the Commission on proposed permanent rule amendments to WAC 220-20-045, Scientific Collection Permits, and WAC 232-12-067, Sale of fish and wildlife by zoos and Aquariums, and repeal of WAC 232-12-276, Scientific permits. These specify application procedures, compliance requirements, and interim and final reports. The Commission will consider action on the rules at its March 10-11, 2006, meeting in Pasco.

FISH AND WILDLIFE CODE INFRACTIONS -- RULE BRIEFING:
Evan Jacoby briefed the Commission on proposed permanent rule amendments that would make certain fish and wildlife violations infractions. The Commission will consider action on the rules at its April 7-8, 2006, meeting in Tumwater.

PERSONAL-USE STURGEON AND BOTTOMFISH RULES -- RULE ACTION:
Evan Jacoby presented proposed permanent rule amendments to WAC 220-20-021, Sale of commercially caught sturgeon and bottomfish. These would clarify that only lawful-sized commercially caught sturgeon may be retained as take-home fish, and that all take-home sturgeon and bottomfish are recorded as such on fish receiving tickets.

No oral testimony on the proposed rule amendments was received during the meeting.

Commissioner Chew moved, seconded by Commissioner Roehl, to adopt the permanent rule amendments to WAC 220-20-021, Sale of commercially caught sturgeon and bottomfish, as proposed. The motion carried unanimously.

LICENSE RECIPROCITY RULES WITH OREGON -- RULE ACTION:
Morris Barker presented WAC 220-55-210, Oregon license reciprocity, that would recognize Oregon license reciprocity so that Washington license residents can fish concurrent waters of the Columbia River mainstem and adjacent ocean waters on the north Oregon coast.

No oral testimony on the rule proposal was received during the meeting.

Commissioner Wecker moved, seconded by Commissioner Roehl, to adopt WAC 220-55-210, Oregon license reciprocity, as proposed. The motion carried unanimously.

COMMERCIAL CRAWFISH GEAR -- RULE ACTION:
Morris Barker present proposed permanent rule amendments to WAC 220-52-035, Commercial shellfish pot gear--Escape mechanism required, that would require a release mechanism (rot cord) for commercial crawfish gear, consistent with the current requirements for recreational gear.

No oral testimony on the proposed rule amendments was received during the meeting.

Commissioner Roehl moved, seconded by Commissioner Solomon, to adopt the permanent rule amendments to WAC 220-52-035, Commercial shellfish pot gear--Escape mechanism required, as proposed. The motion carried unanimously.

SHARK FINNING RULES -- RULE ACTION:
Morris Barker presented proposed permanent rule amendments to WAC 220-20-020, General provisions--Lawful and unlawful acts--Food fish other than salmon. These would act in a complimentary manner to the federal rule, requiring the landing of the entire shark carcass with the fins so that an accurate account of harvest and biological data can be made for the management of sharks.

No oral testimony on the proposed rule amendments was received during the meeting.

2006-2007 SPORTFISH RULE PROPOSALS -- RULE ACTION:
Ross Fuller, Morris Barker, Pat Michaels, and Bob Gibbons presented proposed permanent rule amendments to the following rules:

- WAC 220-56-115, Angling gear--Lawful and unlawful acts;

The Department is to bring the Cedar River proposal back to the Commission at the November 3-4, 2006, Commission meeting in Vancouver instead of waiting until the next two-year cycle.

HPA AND WILDLIFE AREA HCP DEVELOPMENT PROJECTS -- BRIEFING:
At the request of the Commission, Jane Banyard briefed the Commission on two new efforts to explore the development of Habitat Conservation Plans (HCPs) for the Hydraulic Project Approval (HPA) Program and for the Department's Wildlife Areas.

BALLAST WATER INTERIM MANAGEMENT REPORT PLAN RULES -- RULE ACTION:
Scott Smith presented proposed permanent amendments to WAC 220-77-090, Ballast water management and control--Reporting and sampling requirements, to implement 2004 legislation requiring vessel operators subject to RCW 77.120 to submit an interim ballast water management report to the Department by July 1, 2006.

One individual provided oral testimony on the proposed rule amendments at the meeting.

Commissioner Wecker moved, seconded by Commissioner Perry, to adopt the permanent rule amendments to WAC 220-77-090, Ballast water management and control--Reporting and sampling requirements, as proposed. The motion carried unanimously.

PUGET SOUND DUNGENESS CRAB FISHERY -- BRIEFING:
At the request of the Commission's Fish Committee, Lisa Veneroso and Rich Childers briefed the Commission on the Puget Sound Dungeness crab fishery.

NORTH OF FALCON POLICY -- BRIEFING:
Phil Anderson briefed the Commission on the North of Falcon Policy, C-3608, which is in effect until December 31, 2006.

Ten individuals provided oral testimony on the Policy at the meeting.

SEA LION/FISHERIES INTERACTIONS: CONTROL OPTIONS AND TECHNIQUES -- BRIEFING:
At the request of the Commission, Rocky Beach, Steve Jeffries, Guy Norman, and Garth Griffin (ESA Coordinator, NOAA-Fisheries) briefed the Commission on seal and sea lion predation issues in the northwest, and actions that may be undertaken by the State and individuals to control sea lions under Federal and State laws and regulations in 2006.

The Department will explore with other states more options to the seal and sea lion problems and report back to the Commission.

COLUMBIA RIVER SUMMER CHINOOK ALLOCATION POLICY -- DECISION:
Cindy LeFleur, Bill Tweit, and Heather Bartlett presented the Mainstem Columbia River Summer Chinook Allocation for Non-Indian Fisheries Below Priest Rapids Dam, 2006-2010, Policy C-3616, for adoption. The Policy also includes Guiding Principles and Management Objectives.

Twelve individuals provided oral testimony on the Policy at the meeting.

Commissioner Roehl moved, seconded by Commissioner Chew, to adopt the following policy guidance relative to the mainstem Columbia River summer chinook fishery:

  1. The five-year Policy C-3616 titled "Mainstem Columbia River Summer Chinook Allocation for Non-Indian Fisheries Below Priest Rapids Dam, 2006 through 2010, as presented by staff.

  2. The Director shall work with the Oregon Department of Fish and Wildlife to achieve implementation of this Commission action in a manner that results in concurrent regulations between the two states. The Director shall consult with the Commission Chair if it becomes necessary to deviate from the Commission's Policy to achieve concurrent regulations with Oregon.

Commissioner Roehl moved, seconded by Commissioner Chew, to amend the motion by adopting a termination date of December 31, 2007, making it a two-year policy not five-year policy. The motion to amend the motion carried unanimously.

Commissioner Roehl moved, seconded by Commissioner Mahnken to amend the motion by changing "Meet Colville and Wanapum..." to "Address Colville and Wanapum…" under Guiding Principles. The motion to amend the motion carried unanimously.

Commissioner Perry moved, seconded by Commissioner Roehl, to amend the motion by changing "Recognize economic benefits…" to "In shaping fisheries, consult with stakeholders to recognize economic benefits…" under Fisheries Management Objectives. The motion to amend the motion carried unanimously.

Commissioner Roehl moved, seconded by Commissioner Chew, to amend the motion by changing 2010 to the termination date of 2007 throughout the Policy. The motion to amend the motion carried unanimously.

Commissioner Roehl moved, seconded by Commissioner Solomon, to amend the motion by:

- Under Fisheries Management Objectives, add "following stakeholder consultation in the North of Falcon process" after "...set by the Columbia River Compact…".
- Under Delegation of Authority, add "and North of Falcon stakeholder consultation processes" after "…through the Columbia River Compact…" and delete "process" after "…Compact…".

The motion to amend the motion carried unanimously.

The motion, as amended, carried unanimously.

STRATEGIC PLAN DEVELOPMENT -- BRIEFING:
Sue Patnude briefed the Commission on the Department's 2007-2009 biennial strategic plan development.

Approval of Ballast Water Interim Management Report Plan Rules

- Motion by Wecker, second by Perry, to adopt the permanent rule amendments to WAC 220-77-090, Ballast water management and control--Reporting and sampling requirements, as proposed. The motion carried unanimously.*

Approval of Columbia River Summer Chinook Allocation Policy

- Motion by Roehl, second by Chew, to adopt the following policy guidance relative to the mainstem Columbia River summer chinook fishery:

  1. The five-year Policy C-3616 titled "Mainstem Columbia River Summer Chinook Allocation for Non-Indian Fisheries Below Priest Rapids Dam, 2006 through 2010, as presented by staff.
  2. The Director shall work with the Oregon Department of Fish and Wildlife to achieve implementation of this Commission action in a manner that results in concurrent regulations between the two states. The Director shall consult with the Commission Chair if it becomes necessary to deviate from the Commission's Policy to achieve concurrent regulations with Oregon.

Motion by Roehl, second by Chew, amend the motion by adopting a termination date of December 31, 2007, making it a two-year policy not five-year policy. The motion to amend the motion carried unanimously.

Motion by Roehl, second by Mahnken, to amend the motion by changing "Meet Colville and Wanapum..." to "Address Colville and Wanapum…" under Guiding Principles. The motion to amend the motion carried unanimously.

Motion by Perry, second by Roehl, to amend the motion by changing "Recognize economic benefits…" to "In shaping fisheries, consult with stakeholders to recognize economic benefits…" under Fisheries Management Objectives. The motion to amend the motion carried unanimously.

Motion by Roehl, second by Chew, to amend the motion by changing 2010 to the termination date of 2007 throughout the Policy. The motion to amend the motion carried unanimously.

Motion by Roehl, second by Solomon, to amend the motion by:

- Under Fisheries Management Objectives, add "following stakeholder consultation in the North of Falcon process" after "...set by the Columbia River Compact…".
- Under Delegation of Authority, add "and North of Falcon stakeholder consultation processes" after "…through the Columbia River Compact…" and delete "process" after "…Compact…".

The motion to amend the motion carried unanimously.

The motion, as amended, carried unanimously.
