FISH AND WILDLIFE COMMISSION
MEETING via CONFERENCE CALL*

WHAT:

A. HYDRAULIC PERMITTING APPROVALS (HPA) ADMINISTRATIVE APPEALS PROCESS CHANGES – RULE BRIEFING:

Department staff (Lisa Wood, Habitat Program) will brief the Commission on proposed rule amendments resulting from 2010 Legislation that eliminates the Administrative Appeals Board and transfers functions to the Pollution Control Hearings Board effective July 1, 2010 (Chapter 43.21B RCW). The proposed amendments also clarify various administrative procedures associated with appealing HPA decisions and orders imposing civil penalties.

WAC 220-110-030, Hydraulic project approvals, procedures;
WAC 220-110-340, Freshwater technical provisions; and
WAC 220-110-350, Formal appeal of administrative decisions.

The public hearing opportunity and Commission final rule action on these proposals is scheduled for the August 6-7, 2010, Commission meeting in Olympia. Visit the Department’s Rules Information Center webpage on the Internet for more information at: http://www.wdfw.wa.gov/about/regulations.

B. GENERAL DISCUSSION:
Commissioners and Department staff will discuss recent activities and items of interest, including agenda topics and logistics for various upcoming Commission meetings.

*WHERE: The meeting will take place via telephone conference call. The public may listen to the discussion via speakerphone in the Commission Office at the Department of Fish and Wildlife, Natural Resources Building, 5th floor, 1111 Washington Street SE, Olympia. No public input will be accepted during the call.
